School Districts Receive Legal Notice in Regards to Masking Policies
ERIE, PA (January 7, 2022) – Erie County PA Parents Protecting Children, a partner of the Erie County Parents United Coalition, with the assistance of the Law Office of Tucker Hull, has put nine local school districts on notice that their masking policies and any future test-to-stay programs are likely discriminatory and susceptible to further legal action.
Based on the recent rulings of the Commonwealth Court and the PA Supreme Court that the Acting Secretary of Health lacked legal authority to require masks, and the rescinding of the Erie County mask mandate by County Executive Brenton Davis, ECPPC has asked the following nine districts to remove any iteration of the mask mandate in their health and safety plans. These districts have refused to comply:
- Millcreek Township School District (represented by Timothy Sennett, Esq.)
- Corry School District (represented by Jennifer Gornall, Esq.)
- Harbor Creek School District (represented by Christopher Sennett, Esq.)
- Girard School District (represented by Christine McClure, Esq.)
- Fort LeBoeuf School District (represented by George Joseph, Esq.)
- Northwestern School District (represented by George Joseph, Esq.)
- Fairview School District (represented by George Joseph, Esq.)
- General McLane School District (represented by James McDonald, Esq.)
- North East School District (represented by Timothy Sennett, Esq.)
Coalition members worked closely with J. Chadwick Schnee, Esq. of Tucker Hull to author the letter on their behalf. He is one of the attorneys who successfully challenged the Acting Secretary of Health’s illegal masking order in Commonwealth Court.
The coalition is comprised of several local county chapters of state and national organizations, which include Erie County PA Parents Protecting Children; Pennsylvania Coalition for Informed Consent – Erie County; and Moms For Liberty – Erie County, PA.
